The Appearance Bond Process.... To bond a person out of jail involves a contractual undertaking guaranteed by a bail bond agent and the individual posting the bond. The defendant must appear each and every time the judge requires them to.
Typically, a family member or friend of the defendant contacts a bail agent to arrange the posting of a bond. The family member or friend signs a contract to guarantee that they will pay the full amount of the bond if the defendant fails to appear in court.
The person signing the contract must show proof of employment, residency and means to pay the full amount of the bond if the defendant fails to appear for all court dates.
If the defendant "fails to appear for their court dates" the person signing the contract is immediately responsible for the full payment of the bond amount. And also, the one who signs the contract is responsible for all expenses the bail bond agent incurs while looking for the defendant, and all expenses in transporting the defendant back to the courts jurisdiction.
The cost for the appearance bailbond, is a non-refundable premium fee of 10% for each bond over $1,000 and $100 for each bond under $1,000. The cost is set by the State of Florida and every bondsman charges the same, no more, no less. Full payment for the premium is due when signing the contract.
Terms and Conditions of the Bond
The Bailbondsman, as bail, shall have control and jurisdiction over the defendant during the term for which the bond is executed and shall have the right to apprehend, arrest and surrender the defendant to the proper officials at anytime as provided by law. It is understood and agreed that the happening of any of the following events constitutes a breach of contract with the bondsman, and the bondsman shall have the right to apprehend, arrest and surrender the defendant, with no right to a refund of premium paid.
SALIENT CONDITIONS OF BOND AGREEMENT
- If the defendant departs the courts jurisdiction without the written consent of the court and the bondsman. Defendant must not leave the County or State.
- If the defendant has a change of address, phone number or employment and fails to notify the bailbondsman in writing of such change.
- If the defendant commits any act which constitutes reasonable evidence of defendants intention to cause forfeiture of bond.
- If the defendant is arrested and incarcerated for any offense other than a minor traffic violation.
- If defendant makes any material false statements to obtain the appearance bond including the failure to produce agreed security for the bond.
A defendants failure to appear in court may violate F.S. 843.15 and this becomes an additional criminal charge.
Warning: Any person who knowingly and/or with intent to injure, defraud or deceive any insurer, files a statement of claim or an application for a bond containing any false, incomplete, omission or misleading information is guilty of a felony of the third degree.
